General Terms and Conditions

Welcome to Footballs Legacy.

We are a platform specializing in the buying and selling of unique and exclusive sports memorabilia (mainly high-value historical and sentimental football memorabilia), independent third-party authentication services, a "Legacy FC" VIP membership club, and, starting in 2027, specialized educational content (Academy).

Due to the very particular nature of our catalog — unique, irreplaceable items, often of high economic value, with a strong collector investment component and predominantly international sales — it is essential for all users to carefully read these General Terms and Conditions before:

  • Making any purchase

  • Subscribing to the Legacy FC club

  • Contracting on-demand search or certification services

  • Accessing Academy educational content

  • Participating in any commercial or membership interaction on our website

These conditions regulate the contractual relationship between you (as a buyer, member, student, or user) and Footballs Legacy. They contain key information about:

  • The uniqueness and irreplaceability of most items

  • Strict authenticity and certification rules

  • Legal limitations on the right of withdrawal (very common in exclusive collecting)

  • The distribution of responsibilities in international shipments, customs, and duties

  • The inherent risks of the sports memorabilia market as a collectible/investment asset

  • Specific subscription and cancellation rules for the Legacy FC club

  • Protection of intellectual property in the Academy

Reading and understanding these conditions is not a mere formality: it is a protection for both parties. By conducting any operation on footballslegacy.es, you declare that you have read, understood, and fully accepted these General Terms and Conditions (including all their clauses on limitation of liability, exceptions to withdrawal, and market risk warnings). If you do not agree with any of these clauses, please do not make any purchase, subscription, or contract on our platform. These conditions are updated periodically. The current version will always be the one published on the website at the time of each operation.


1. Identification and Legal Regime

The commercial activity is currently carried out by José Galdo Escourido as a sole proprietor. Once the commercial company is established, it will assume contractual ownership.

Activity: Online and international sale of sports collectibles (mainly football memorabilia, such as boots, jerseys, and balls), authenticity certification services, "Legacy FC" membership club, and, starting in 2027, an online training academy. The company operates from Spain, with a physical establishment for secure storage and VIP client visits, and sells nationally and internationally, with an emphasis on markets outside the EU (up to an estimated 70% of turnover). No territory is excluded, except for imperative legal restrictions (e.g., international sanctions).

FOOTBALLS LEGACY is governed by applicable Spanish and European legislation, including Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users (hereinafter, "LGDCU"), Regulation (EU) 2018/302 on geoblocking, and Regulation (EU) 2016/679 (GDPR) for data protection. In international sales, additional rules of international trade, customs, and bilateral treaties will apply.

 

2. Nature of Items and Stock

2.1. Uniqueness: The customer acknowledges and accepts that most products are unique, exclusive, and collectible items (e.g., match-worn or vintage memorabilia), with possible limited availability in certain cases (e.g., football boots in different sizes or numbered limited editions of jerseys or balls). Replenishment of sold-out items is not guaranteed, given their irreplaceable nature and the material impossibility of reproducing them under identical historical or usage conditions. FOOTBALLS LEGACY aims to offer items in the best possible state of preservation, preferably new, with original tags and intact packaging when applicable. However, given the historical and pre-used nature of many collectible items: Occasionally, items are offered that show signs of actual use (match-worn), natural wear, or marks from the passage of time.

Some products may lack the original box or the box may have cosmetic defects (dents, creases, stains, minor tears, etc.).

Certain items (e.g., balls, boots, jerseys) may have imperfections expressly detailed in the product description (stains, patches, color loss, worn stitching, etc.).

All these characteristics are described in detail and truthfully on each product's page, accompanied by actual photographs that reflect the exact condition of the item at the time of publication. The customer declares to have examined and accepted said descriptions and photographs before confirming the purchase, expressly waiving any subsequent claims for aspects already informed. The customer assumes that the acquisition of collectible items implies accepting their unique and irreplaceable condition, including possible variations from a "factory new" state.

2.2. Availability: Items are kept in secure physical stock at the FOOTBALLS LEGACY office. Once an item is sold, it will not be restocked except for exceptions. FOOTBALLS LEGACY reserves the absolute right to remove any item from the online catalog without prior notice, due to reasons such as private sales, reservations for "Legacy FC" members, publishing errors, or commercial decisions, provided that the purchase contract has not been formalized.

The customer acknowledges that the removal of items will not generate the right to claim for lost profits, loss of purchase opportunity, or additional compensation of any kind.

2.3. Synchronization: With a limited catalog (150-200 references), the risks of availability errors due to synchronization are minimal. In the event of an exceptional error (e.g., simultaneous sale), the customer will be notified immediately, and a full refund of the amount paid (including shipping costs if applicable) will be processed, without the right to additional compensation for damages.

2.4. On-Demand: FOOTBALLS LEGACY offers a service for searching and acquiring specific items at the customer's request ("on-demand"). This service requires a separate mandate contract, with a non-refundable initial payment of 20% as remuneration for consulting services, search management, negotiation, and potential commissions.

This provision is a payment for services rendered and is independent of the final price of the item (if located). It is non-refundable in any case, even if the item is not located or the transaction is not completed due to reasons beyond FOOTBALLS LEGACY's control.

The customer fully assumes the risk of not finding the desired item and expressly waives any claim for reimbursement of the provision.

If the item is located, the sale will be formalized with independent price and conditions, without the initial provision being deducted from the final price unless expressly agreed otherwise.

2.5. VIP Member Reservations: "Legacy FC" members have priority access to items not displayed in the online store. FOOTBALLS LEGACY may reserve or remove items for these clients without public notification.

 

3. Authenticity, Certification, and Valuation

3.1. Authenticity Guarantee: FOOTBALLS LEGACY guarantees the authenticity of all items sold, based on its experience and collaborations with independent external experts. As an added value included in the price of all purchases, FOOTBALLS LEGACY will provide the customer with its own Document of Originality and Chain of Custody (not an independent expert certificate). This document: Summarizes the verification carried out by Footballs Legacy and, when applicable, the opinion of external experts or photo-match services.

Includes a unique serial number, detailed description of the item, photos, and known chain of custody to date.

Does not include economic valuation, estimated price, or appraisal.

Does not constitute an expert report or a certified expert's report.

Items ≥ €2,000: In addition to the Document of Originality, an authenticity certificate or photo-match service issued by an accredited third-party expert is included (or offered upon request), with their own fees and independent responsibility.

High-value items are delivered with a unique security seal (numbered technical tie or inviolable holographic sticker). Tampering with or removing the seal may negatively affect any subsequent claim regarding the authenticity or condition of the item. Important: The Document of Originality issued by Footballs Legacy does not replace a formal expert report. To obtain an economic appraisal or an independent expert certificate, the customer must explicitly request it as an additional service (issued by accredited and certified external experts or by Footballs Legacy in its appraisal modality).

Provenance from Auctions: If the item comes from an auction house, the original authenticity document from that house will be attached, along with any additional documentation to validate the origin.

3.2. Company Role: FOOTBALLS LEGACY acts as an expert intermediary, not as a certified expert. Certifications are carried out by independent third parties to guarantee objectivity and impartiality. For high-value items, photo-matching (photographic analysis) will be offered at the express request of the customer, with private, unpublished fees.

3.3. Documentation Custody: A physical and digital certificate will be provided (both non-transferable and numbered). FOOTBALLS LEGACY will keep an archived copy indefinitely for future verification purposes (e.g., in case of loss by the customer or their heirs). Reissuing lost certificates will incur a reasonable administrative cost (currently €50 plus shipping and processing fees, subject to update due to cost variation). The customer expressly accepts this cost policy when making the purchase.

3.4. Appraisals: Valuations are indicative estimates based on closed auction data (hammer prices), online sales, and market analysis. They do not constitute formal expert appraisals or guarantee future value. This service is independent of authenticity and is offered upon request, with an additional cost (10% of the estimated value for external collections).

3.5. Limitation of Liability: FOOTBALLS LEGACY is not responsible for future revaluations, loss of value, market fluctuations, or external changes (e.g., player deaths, retirements, or trends). The customer expressly waives any claim for market fluctuations and fully assumes the risks inherent in memorabilia investment. It does not offer financial advice; any advice is technical and non-binding. It is expressly warned that investing in collectibles carries risks and should not be considered an alternative to regulated financial products.

FOOTBALLS LEGACY does not provide regulated financial or tax advisory services. Value estimates do not constitute investment recommendations or tax advice. The customer should consult independent advisors in their country of residence to evaluate tax implications (e.g., capital gains taxes, import VAT) or investment.


4. Prices, Taxes, and Payments

4.1. Prices: Prices include applicable VAT in accordance with current tax regulations. The final price (including VAT, shipping, and extras) is clearly stated before confirming payment. Special schemes such as REBU or profit margin for art/second-hand goods are not applied, except for exceptions for items >100 years old (rare in the catalog).

4.2. Sales Outside the EU: An official digital invoice without VAT is issued. The customer assumes all duties, import taxes, customs fees, and DUA. FOOTBALLS LEGACY provides a general estimate based on standard rates but does not guarantee accuracy; actual costs are the sole responsibility of the buyer. FOOTBALLS LEGACY is not responsible for the impossibility of delivery due to customs, legal restrictions, or prohibitions in the destination country.

4.3. Payment Methods: Accepted: credit/debit card, bank transfer, and installment payments (for items ≥ €2,000, up to 3 interest-free installments, subject to anti-fraud verification). For installment payments, digital signature of debt acknowledgment is required. Failure to meet any installment payment deadline will result in the automatic suspension of shipment (if applicable) and immediate collection of the outstanding balance, without prejudice to appropriate legal actions.

4.4. Anti-Fraud Measures: For items ≥ €2,000, identity verification (DNI/NIE/passport) and signature upon receipt are required. FOOTBALLS LEGACY has specialized insurance policies for art/collecting and additional IT coverage against fraud. In case of suspicion, the transaction may be canceled without liability.

 

5. Shipments, Customs, and Transfer of Risk

5.1. Carriers: Services such as Correos, Correos Express, UPS, DHL, or FedEx are used, selected according to destination to optimize security and delivery times.

5.2. Insurance: Mandatory and all-risk for items ≥ €2,000, covered by FOOTBALLS LEGACY. For < €2,000, optional and at the customer's expense.

5.3. Transfer of Risk: In accordance with article 66 ter of the LGDCU, the risk of loss or deterioration of the goods is transferred to the buyer only when he, or a third party indicated by him who is not the carrier, has acquired material possession of the goods (signature upon receipt or effective delivery). Until then, the risk remains with FOOTBALLS LEGACY.

In case of loss or damage during transport, FOOTBALLS LEGACY will assume responsibility, unless the buyer has chosen and contracted a carrier not offered by FOOTBALLS LEGACY on their own.

5.4. International Sales (Outside the EU)

In all sales outside the European Union, the customer fully assumes all duties, import taxes, customs fees, DUA, and any other local costs or fees applicable in their destination country. FOOTBALLS LEGACY provides an indicative estimate of these costs before confirming the order but does not guarantee their accuracy or assume responsibility for variations, regulatory changes, or customs retentions.

The customer declares and guarantees that the import of the item is legal in their country and complies with all local regulations (including restrictions on cultural goods or sports memorabilia). If the customer refuses to pay duties or customs fees and the package is returned or abandoned, no refund will be issued until the item returns to our offices in perfect condition. In that case, return shipping costs, storage, and administrative management fees will be deducted. FOOTBALLS LEGACY may declare the shipment abandoned after 30 days of retention and retain the amount as compensation.

5.5. Customs Retention or Rejection: If the item is held in customs for any reason, FOOTBALLS LEGACY will reasonably cooperate in resolving the issue (providing required documentation or information), but the buyer fully assumes delays, additional costs, and any resulting consequences. In case of shipment rejection due to non-payment of duties, import taxes, or other customs fees (sole responsibility of the buyer), no refund will be issued until the item returns to our facilities in perfect condition. All transportation costs (to and from), storage, customs management, and any other incurred costs will be deducted from the amount to be refunded.

After 30 days from the notification of retention or rejection due to reasons attributable to the buyer (non-payment, refusal to receive, etc.), FOOTBALLS LEGACY may declare the shipment abandoned and retain the total amount paid as compensation for management fees, storage, and loss of opportunity to sell a unique item. The customer expressly waives any claim for the loss of the item in such cases.

Legality of Import: The customer guarantees that the import of the item is legal in their country. FOOTBALLS LEGACY assumes no responsibility for seizures, destruction, or penalties arising from local regulations on cultural goods or brands in the destination country. In case of seizure due to illegality at the destination, the customer will assume the total loss of the amount as consequential damages caused to FOOTBALLS LEGACY.

5.6. Delivery Times: Estimated and non-binding; they do not generate a contractual obligation for delivery on an exact date. Delays due to customs or force majeure do not generate liability.

 

6. Right of Withdrawal and Cancellations

6.1. General Rule: In accordance with LGDCU, 14 calendar days to withdraw for standard items not excluded (e.g., common size boots <€1,000).

6.2. Exceptions (Art. 103 LGDCU): Does not apply to:

  • Personalized or unique goods (majority of the catalog, due to exclusivity and age >25 years).

  • Items subject to market fluctuations (investment memory).

  • Sealed product whose opening affects its market value: Items supplied with security seals or third-party certifications that, by their nature, cannot be returned once unsealed or tampered with without an objective loss of their market value (Art. 103.i LGDCU).

It is recommended to verify the applicability of withdrawal in each product's description; purchase implies express waiver of the right of withdrawal when applicable law so provides.

6.3. Return Conditions: The customer assumes return costs. The item must be returned in original condition, with seals, labels, and certificates intact. Tampering with the certificate invalidates the return. For items ≥€2,000, it is a recommended condition for processing any claim for shipping damage to present an uncut video of the package opening process (unboxing), clearly showing the condition of the seal and the integrity of the item. Failure to comply with this requirement does not exempt from the obligation to pay for the item or other costs derived from shipping. For transport/customs negligence, evidence (photos/videos) is required; reimbursement only after inspection.

6.4. Pre-Cancellation: Possible for <€2,000 before shipping. For ≥€2,000, only for proven negligence by FOOTBALLS LEGACY.

7. "Legacy FC" Membership Club

7.1. Subscription: Tiers: First 15 members free (exclusive invitation); next 15 at €19/month; rest at €29/month. No permanence or minimum period or free trial.

7.2. Automatic Renewal: By default, with 15 days prior notice. Cancellation via email (info@footballslegacy.com) 7 days before billing.

7.3. Benefits: Priority and exclusive access to non-public items, right of first refusal. Does not guarantee availability; priority by order of interest/payment. Quotas are limited (initial, expansion, waiting list). FOOTBALLS LEGACY may unilaterally modify benefits, prices, or club conditions with 30 days prior notice; active member's continuity after said notice implies automatic acceptance of the modifications.

7.4. Withdrawal: Upon immediate access, the right is lost if immediate execution is expressly consented to.

7.5. Cancellation: Effects at the end of the current month. Benefits are not retained post-cancellation. Re-entry is not preferential, subject to availability.

 

8. Academy 

8.1. Model: Recorded courses with indefinite access, final certificate. No live classes initially.

8.2. Access: Individual, non-transferable account. Sharing prohibited; detection of shared IPs/devices causes cancellation without refund.

8.3. Intellectual Property: Exclusive content of FOOTBALLS LEGACY. Downloading, recording, redistribution, or use without written authorization is prohibited. Improper use of content will generate liability for damages caused, without prejudice to appropriate legal actions.

8.4. Refund: Withdrawal excluded for digital content executed immediately (with express consent). 14-day commercial guarantee via Hotmart; refund processed in 5 days by FOOTBALLS LEGACY or automatically by the platform.


9. Additional Services

9.1. Item Consignment Service

This service consists of the temporary consignment of collector's items owned by third parties (collectors, former players, referees, etc.) in the secure facilities of FOOTBALLS LEGACY in Las Rozas (Madrid). The consignor delivers the items for an initial period of 100 calendar days, extendable by mutual written agreement.

Upon receipt, FOOTBALLS LEGACY performs a detailed inventory (description, photos, condition) and insures the items under its specialized policy.

FOOTBALLS LEGACY will promote the items to its clientele (including Legacy FC members and private sales), informing the consignor of offers received.

If an offer is accepted, FOOTBALLS LEGACY will issue an invoice to the buyer (VAT included) and transfer the net amount to the consignor, deducting a 20% commission (on the final sale price, VAT not included in the commission).

Once paid, FOOTBALLS LEGACY fully manages shipping (urgent and insured), incidents, withdrawal (if applicable), cancellations, refunds, and customs retentions. The consignor is exempt from liability for any post-sale incidents.

The consignor exclusively assumes the cost and risk of the initial shipment to FOOTBALLS LEGACY's facilities.

If no sale is materialized within 100 days, FOOTBALLS LEGACY will return the items to the consignor (return costs borne by the consignor) or, by mutual written agreement, extend for another 100 days.

This service requires a specific consignment agreement (physical or digital) signed by the consignor upon delivery of the items, which incorporates these conditions. FOOTBALLS LEGACY acts as a commercial agent (Art. 244 Commercial Code), without assuming ownership or value risks of the items.


9.2. Immediate Purchase Service ("I'll buy your item")

FOOTBALLS LEGACY offers immediate purchase of collector's items sent by individuals or collectors. The seller sends photos/detailed description, and FOOTBALLS LEGACY makes a binding offer (subject to physical inspection).

If accepted, immediate payment (bank transfer or similar) is made after receipt and verification of authenticity/condition.

The seller declares to be the legitimate owner, free of encumbrances and with a clear chain of custody.

FOOTBALLS LEGACY assumes no responsibility for subsequent claims by the seller (e.g., if the item is resold at a higher price). The seller expressly waives any claim for loss of profit or future price difference.

This service is governed by the general purchase and sale rules of these GTC, with risk transfer upon payment and delivery.


9.3. "Gift Footballs Legacy" Service (Voucher or Gift Card)

This service allows the purchase of a Footballs Legacy experience gift voucher for predefined amounts (e.g., €500, €1,000, etc.), to be given to third parties. The voucher is delivered in physical format (card + personalized envelope) or digital (email/WhatsApp with unique code).

Validity: 12 calendar months from the issue date.

The beneficiary activates the voucher by contacting FOOTBALLS LEGACY, who manages the online purchase of items or services for the voucher amount (subject to availability).

Not refundable in cash (except for the 14-day right of withdrawal if LGDCU applies to the initial buyer). Not cumulative or exchangeable for money.

FOOTBALLS LEGACY does not guarantee availability of specific items when activating the voucher.

The GTC of contracting apply to the final purchase.


9.4. Service "Can't find what you're looking for? We'll find it for you!"

This is a non-binding search service for specific items requested by the customer. FOOTBALLS LEGACY will evaluate the request and communicate if it is feasible, estimating the approximate timeframe and price.

It does not constitute a contractual commitment or an obligation of result. Footballs Legacy will act diligently but is not responsible if it does not locate the item, if the final price differs, or if the transaction does not materialize. Any prior negotiation does not generate liability for non-performance. The customer assumes that this is a good faith management without guarantee of success or refund of amounts paid for the search concept.


10. Limitation of Liability

10.1. Scope and Cap of Liability: The total liability of FOOTBALLS LEGACY arising from any breach of contract or damage related to the acquisition of items or services is strictly limited to the amount effectively paid by the customer for said item or service. In no case shall FOOTBALLS LEGACY be liable for indirect, consequential, loss of profit, moral damages, or loss of business opportunity.

10.2. Specific Exclusions by Nature of the Asset: Given the nature of collector's items, FOOTBALLS LEGACY assumes no responsibility for:

  • Market Fluctuations: Future revaluations, market value drops, or lack of liquidity of the asset.

  • Inadequate Maintenance: Deterioration derived from negligent conservation by the customer (e.g., direct exposure to sunlight, humidity, extreme temperatures, or handling without technical gloves).

  • Natural Wear and Tear: Alterations inherent to the passage of time in vintage or match-worn materials.

10.3. Force Majeure: FOOTBALLS LEGACY shall not be liable for the non-performance or delay in its obligations when these are due to events of force majeure or unforeseen circumstances, including but not limited to: natural disasters, pandemics, general strikes, civil unrest, massive cyberattacks, or critical disruptions of global logistics infrastructure.

10.4. Actions of Third Parties and Logistics: The customer acknowledges that FOOTBALLS LEGACY contracts third-party services for the execution of the contract (carriers, payment gateways, and customs services). FOOTBALLS LEGACY will be liable to the customer for the correct execution of these services in accordance with the law; however, it will be exempt from liability when the damage or delay is exclusively attributable to the action of a third party outside its organizational control, the intervention of customs authorities, or the lack of cooperation of the customer in receiving the shipment.


11. Data Protection and Security

11.1. GDPR: Data processed for sales, shipping, and marketing (with consent). Rights: access, rectification, etc., via info@footballslegacy.es. Privacy policy available on the website.

 

12.  Prevention of Money Laundering (AML/CTF)

12.1. Regulatory Compliance: FOOTBALLS LEGACY strictly complies with Law 10/2010 on the Prevention of Money Laundering and the Financing of Terrorism. The customer undertakes to provide any information or documentation that FOOTBALLS LEGACY requests to comply with its legal obligations of identification and customer knowledge (KYC).

12.2. Mandatory Identification: For individual or accumulated transactions equal to or greater than €10,000 (or its equivalent in foreign currency), the customer must mandatorily provide a copy of their valid identification document (DNI, NIE, or Passport) and, in the case of legal entities, a document proving their real ownership.

12.3. Verification of Funds: FOOTBALLS LEGACY reserves the right to request additional information about the origin of funds in high-value transactions or in cases of suspicion of unusual operations.

12.4. Faculty of Cancellation: FOOTBALLS LEGACY may block, cancel, or refuse to execute any transaction if the customer does not provide the required documentation or if there are reasonable indications of non-compliance with AML/CTF regulations, without this generating any right to compensation for the customer.


13. Applicable Law and Jurisdiction

13.1. Applicable Law: This contract is governed in all its points by Spanish legislation. In the case of international sales to consumers, this choice of law is made without prejudice to the protection afforded to the customer by the mandatory provisions of the law of their habitual residence, provided that such rules are mandatorily applicable in accordance with Art. 6 of Regulation (EC) 593/2008 (Rome I).

13.2. Jurisdiction: For the resolution of any judicial dispute arising from the interpretation or execution of this contract, the parties submit to the exclusive jurisdiction of the Courts and Tribunals of the city of Madrid (Spain), expressly waiving any other jurisdiction that may correspond to them. However, if the customer is a consumer, the imperative procedural rules on international judicial competence shall apply.

13.3. Dispute Resolution: FOOTBALLS LEGACY informs that it does not voluntarily submit to consumer arbitration systems or dispute resolution platforms outside the European Union, unless expressly required by law in the destination country.

 

13 BIS. International Sales Regime and Local Compliance

A) Scope of Action: The customer acknowledges that the activity of FOOTBALLS LEGACY is mainly directed to the Spanish and European Union market. Sales made to third countries are executed under the Spanish general conditions, the customer accepting that the Website is not designed to specifically comply with the local consumer regulations of each foreign jurisdiction.

B) Assumption of Risks and Regulatory Differences: Outside of the imperative legal provisions that are directly and inalienably applicable, the customer assumes the risks derived from the regulatory differences between their country of residence and Spain (especially regarding commercial warranty periods, withdrawal procedures, and certification standards), as well as the exclusive responsibility for compliance with local taxes, customs duties, and import restrictions in force in their territory.

C) Express Acceptance: The customer declares to have been informed of these conditions of submission and international regime, accepting them expressly and unequivocally when completing the contracting process.
